A Winona County Judge ruled Wednesday that Adam Fravel will retain his child visitation privileges if he bails out of jail. Judge Mary Caroll Leahy did suspend Fravel’s parental rights while he’s incarcerated but said suspending Fravel’s contact rights permanently is “putting the cart before the horse.” The ruling came during a child protection hearing for Fravel, who’s charged with murdering Madeline Kingsbury, the mother of the two children they share.
The children are in the care of Kingsbury’s parents. Anna Tobia, an attorney for the Kingsbury’s parents, requested that Fravel’s visitation and contact rights be suspended immediately and Winona County’s Rebecca Church told the court the county will be filing to permanently terminate Fravel’s parental rights by week’s end. Judge Leahy agreed that Fravel being in jail is a good reason to suspend visitation rights but said a child protection hearing is not the right venue to decide the matter.
“Your rush to judgment is misplaced in these proceedings,” Judge Leahy told the county. “Quit putting the cart before the horse and get this taken care of in family court.”
