US Supreme Court Denies Hearing Case Against Winona County Frac Sand Mining Ban

(KWNO) The United States Supreme Court denied hearing a case challenging a fracking ban in Winona County this week.

Minnesota Sands sued the county claiming the ban interfered with interstate commerce and therefore was unconstitutional. The ban was upheld in Winona County District Court, a state appeals court, and the Minnesota Supreme Court.

The Land Stewardship Project issued a statement on the high court’s decision saying they are “pleased that the court has made the right decision, respecting the people of Winona County’s right to keep their communities safe from this harmful industry.”

“Banning this type of mining based on the end-use of this resource is not only unconstitutional, it takes away the rights of landowners and defies common sense,” said Minnesota Sands President Rick Frick when the company filed the lawsuit in 2017.
